Plaintiff alleges:

1. Whereas defendants, FIRESIGN THEATRE have released some
collected performances by "The Firesign Theatre" from 1969 - 1982.

2. Whereas this material was written, performed, and produced
by the FIRESIGN THEATRE, which consists of Phil Austin, Phillip
Procter, Peter Bergman and David Ossman.

3. Whereas the selections entitled "Profiles in Butter," "Jimmy
Clicker" and "Golf Rat Shoot" were produced by Fred Jones, and
that Post-Production was provided by Fred Jones Recording Services.

4. Whereas the defendants would like to thank Jack Poet (who is
a real person) for his altitude and friendship over the entire
length of FST's career. Performing on the piano and some vocals
on the "Jack Frost Commercials" is David Grimm, a dear friend
who passed away in 1971.

EXHIBIT "A"

SIDE ONE: "LAWYER'S HOSPITAL."

This piece is a compilation of two memorable performances from
our National Tour of 1981, which took us across the country
together for the first time since 1974. We had a wonderful
time and renewed old friendships. Of all the recordings
that were made from the shows - from Town Hall in New York
to Virginian Beach, from Chicago's Park West Theatre to
Royce Hall in Los Angeles and some fifteen others - these
are our favorites: Denver's Rainbow Theatre and San Francisco's
York Theatre. Our special thanks to everyone connected
with these performances and all our shows.

EXHIBIT "B"

SIDE TWO: "POLITICS AS USUAL."

This is a collection of ten years' worth of heretofore
unreleased pieces dealing with the American electoral
process and its participants. "Profiles in Butter," "Jimmy
Clicker," and "The Golf Rat Shoot" were originally recorded
as part of "The Campaign Chronicles," which was the umbrella
for the FST's 1980 Election coverage on National Public
Radio's nationwide "Morning Edition." "Thank You, Mr. President,"
is a work we have been honing since 1979, when we re-formed
as a group after several sabbatical years. "The Jack Poet
Commercials" kept us alive in the lean, late 1960's, and
have become a memorable part of the Los Angeles Radio
tradition which, for comedy, is probably the richest in
the country.
